ਉਨ੍ਹਾਂ ਦੇ ਉੱਤੇ "ਕੋਰਟ ਮਾਰਸ਼ਲ" ਦੁਆਰਾ ਮੁਕੱਦਮਾ ਚਲਾ ਕੇ 6 ਅਪਰੈਲ 1857 ਨੂੰ ਮੌਤ ਦੀ ਸਜਾ ਸੁਣਿਆ ਦਿੱਤੀ ਗਈ।

ਕੋਰਟ ਮਾਰਸ਼ਲ ਅਨੁਸਾਰ ਉਨ੍ਹਾਂ ਨੂੰ 18 ਅਪਰੈਲ 1857 ਨੂੰ ਫਾਂਸੀ ਦਿੱਤੀ ਜਾਣੀ ਸੀ, ਪਰ ਇਸ ਨਿਰਣਾ ਦੀ ਪ੍ਰਤੀਕਿਰਆ ਕਿਤੇ ਵਿਕਰਾਲ ਰੂਪ ਨਹੀਂ ਲੈ ਲੈ, ਇਸ ਕੂਟ ਰਣਨੀਤੀ ਦੇ ਤਹਿਤ ਬੇਰਹਿਮ ਬਰਤਾਨਵੀ ਸਰਕਾਰ ਨੇ ਮੰਗਲ ਪਾਂਡੇ ਨੂੰ ਨਿਰਧਾਰਤ ਮਿਤੀ ਤੋਂ ਦਸ ਦਿਨ ਪੂਰਵ ਹੀ 8 ਅਪਰੈਲ ਸੰਨ 1857 ਨੂੰ ਫਾਂਸੀ ’ਤੇ ਲਟਕਾ ਕਰ ਮਾਰ ਪਾਇਆ।
