ದಕ್ಷಿಣದ ಮಹಾದ್ವಾರಗೃಹವಾದ, ಸ್ಟೋನ್ ಗೇಟ್ ವೇ ಲಂಡನ್ ನ್ನಿನ ಅತ್ಯಂತ ಕುಖ್ಯಾತ ಸ್ಥಳಗಳಲ್ಲಿ ಒಂದಾಗಿದೆ: ಇಲ್ಲಿ ಈಟಿಯಿಂದ ಶೂಲಕ್ಕೇರಿಸಲಾದ ದೇಶದ್ರೋಹಿಗಳ ವಿಚ್ಛೇದಿಸಿದ ತಲೆಗಳನ್ನು ಪ್ರದರ್ಶಿಸಲಾಗುತ್ತದೆ.

1593ರಲ್ಲಿ, ಅಹ್ಮದ್‌ ಬಾಬಾರೂ ಸೇರಿದಂತೆ ಅನೇಕ ಟಿಂಬಕ್ಟು'ನ ಪಂಡಿತೋತ್ತಮರನ್ನು ಬಂಧಿಸಿ, ತರುವಾಯ ಕೊಲ್ಲುವುದು ಅಥವಾ ಗಡೀಪಾರು ಮಾಡಿ ಅದಕ್ಕೆ ಅವರು 'ದೇಶದ್ರೋಹ'ವೆಸಗಿದ್ದರೆಂದು ಸಾಡಿ/ದಿ ಅರಸೊತ್ತಿಗೆಯು ಕಾರಣ ನೀಡಿತು.

ಕೆಲವು ರಾಷ್ಟ್ರಗಳಾದ ಬ್ರೆಜಿಲ್ ಮುಂತಾದವು, ಯುದ್ಧಕಾಲದಲ್ಲಿ ದೇಶದ್ರೋಹ ಮುಂತಾದ ಕೆಲವು ಅಪವಾದಾತ್ಮಕ ಪರಿಸ್ಥಿತಿಗಳಲ್ಲಿ ಮರಣ ದಂಡನೆಗೆ ಅವಕಾಶ ನೀಡಿತ್ತು.

ಈ ಎಲ್ಲಾ ಅನಾಹುತಗಳಿಗೆ ನಂದಾವರದ ಲಕ್ಷ್ಮಪ್ಪರಸ ಬಂಗ ಹಾಗೂ ಗೋಪ ಗೌಡರೇ ಕಾರಣರೆಂದು ತೀರ್ಮಾನಿಸಿದ ಬ್ರಿಟಿಷರು, ಅವರ ಮೇಲೆ ದೇಶದ್ರೋಹದ ಪ್ರಕರಣವನ್ನು ಹೇರಿ, 1837 ಮೇ ತಿಂಗಳಲ್ಲಿ ಮಂಗಳೂರಿನ ಬಿಕರ್ನಕಟ್ಟೆಯಲ್ಲಿ ಈರ್ವರನ್ನೂ ಗಲ್ಲಿಗೇರಿಸಿ ತಮ್ಮ ಸೇಡು ತೀರಿಸಿಕೊಂಡರು.

ನಂತರ ವೆನುನುವನ್ನು ಉಪಾಯವಾಗಿ ಲಂಡನ್ ನಿಂದ ರೋಂಗೆ ಕರೆಯಿಸಿಕೊಂಡು, ಅಲ್ಲಿಂದ ಅವರನ್ನು ಅಪಹರಿಸಿ ಇಸ್ರೇಲ್ ಗೆ ಹಿಂದಿರುಗಿಸಲಾಯಿತು ಹಾಗೂ ಇಸ್ರೇಲ್ ನಲ್ಲಿ ಅವರನ್ನು ದೇಶದ್ರೋಹಿ ಎಂದು ತೀರ್ಮಾನಿಸಿ ೧೮ ವರ್ಷಗಳ ಕಾಲ ಸೆರೆಮನೆಗೆ ತಳ್ಳಲಾಯಿತು.

ಸರ್ಕಾರದ ವಿರುದ್ಧ ಯುದ್ಧ, ದೇಶದ್ರೋಹ (ಸೆಡಿಷನ್), ಸುಳ್ಳುಸಾಕ್ಷ್ಯ, (ಪರ್ಜರಿ), ಸೃಷ್ಟನೆ (ಫೋರ್ಜರಿ), ಲಘುಗಾಯ (ಸಿಂಪ್ಲ್ ಹರ್ಟ್), ಆಕ್ರಮಣ (ಅಸಾಲ್ಟ್) ಇವು ಅಸಂಜ್ಞೇಯ ಅಪರಾಧದ ನಿದರ್ಶನಗಳು.

ಸರ್ಕಾರದ ವಿರುದ್ಧ ಅಸಮಾಧಾನವನ್ನು ಪ್ರಚೋದಿಸುವ ಪ್ರಯತ್ನಗಳು ದೇಶದ್ರೋಹ ಪ್ರಕರಣ ಎನಿಸಿಕೊಳ್ಳುತ್ತವೆ.

ಆಗಿನ ಬ್ರಿಟಿಷ್ ಆಳವಿಕೆಯ ಸಮಯದಲ್ಲಿ ಸರಕಾರಿ ಹುದ್ದೆಯಲ್ಲಿರುವರು ಕೇಸರಿ ಪತ್ರಿಕೆಯನ್ನು ಕೊಳ್ಳುವುದು ದೇಶದ್ರೋಹವೆಂದು ಅನಿಸಿಕೊಳ್ಳಲಾಗುತಿತ್ತು.

ಇದು ರಾಷ್ಟ್ರದ ಭದ್ರತೆಗೆ ಅಪಾಯ; ಆದ್ದರಿಂದ ಕವಿಗಳಿಗೂ ದೇಶದ್ರೋಹಿಗಳಿಗೂ ವ್ಯತ್ಯಾಸವಿಲ್ಲ ಎಂಬುದು ಇವನ ತರ್ಕ, ಇಲ್ಲಿ ಇವನ ನೋಟ ವ್ಯವಹಾರಗಳ ಮೇಲು ಮೇಲಣ ತೋರ್ಕೆಯನ್ನು ಮಾತ್ರ ಲೆಕ್ಕಿಸದಂತೆ ಕಾಣುತ್ತದೆ.

ಅಂದರೆ ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಮಾತಿನಿಂದ, ಬರವಣಿಗೆಯ ಮೂಲಕ ಅಥವಾ ಚಿಹ್ನೆಗಳ ಮೂಲಕ ಸರ್ಕಾರದ ವಿರುದ್ಧ ದ್ವೇಷವನ್ನು ಅಥವಾ ತಿರಸ್ಕಾರವನ್ನು ಹುಟ್ಟಿಸಲು ಯತ್ನಿಸಿದರೆ ಅಥವಾ ಅದಕ್ಕೆ ಪ್ರಚೋದಿಸಿದರೆ ಅದು ದೇಶದ್ರೋಹ ಎನಿಸಿಕೊಳ್ಳುತ್ತದೆ.
