इस भाषा को विद्यापति ने देशी भाषा कहा है, किन्तु यह निर्णय करना सरल नहीं है कि हिन्दी शब्द का प्रयोग इस भाषा के लिए कब और किस देश में प्रारम्भ हुआ।

विधि न्यायनिर्णयन (Adjudication) उस विधिक प्रक्रिया को कहते हैं जिसके माध्यम से मामले से सम्बन्धित निर्णय पर पहुँचने के लिये कोई न्यायधीश या मध्यस्थ साक्ष्यों एवं तर्कों की समीक्षा करता है।

इनकी समीक्षा से पता चलता है कि न्यायदर्शन आरंभ में अध्यात्म प्रधान था अर्थात् आत्मा के स्वरूप का यथार्थ निर्णय करना ही इसका उद्देश्य था।

संविभ्रम के गंभीर रोगियों को छोड़कर साधारण रोगियों में सुसंगत विचार और तर्कशक्ति बनी रहती है, यहाँ तक कि चिकित्सक के लिये भी यह निर्णय करना कठिन हो जाता है कि व्यक्ति वास्तव में संविभ्रमी है या नहीं।

न्यायनिर्णयन के द्वारा तीन प्रकार के विवाद सुलझाये जाते हैं-।

कुछ विद्वानों के अनुसार मीमांसा के बिना वाक्यार्थ का निर्णय करना कठिन है, क्योंकि अमुक वाक्य उपस्थित अर्थ में प्रमाण है अथवा अन्य अर्थ में, इस विचार के निर्णय में जो निष्कर्ष आता है उसे मीमांसा कहा गया है, किंतु यहाँ मीमांसा शब्द का अर्थ दर्शन से है।

‘गीतगोविन्द’ काव्य का रचना-कौशल इस प्रकार सर्वथा नवीन एवं नितान्त मौलिक है कि उसके काव्य-रूप का निर्णय करना ही दुष्कर बन गया है।

विधि दार्शनिक विधिक रीतिवाद (Legal formalism) न्यायनिर्णयन का वर्णनात्मक सिद्धान्त भी है और न्यायधीशों द्वारा मामलों का निर्णय कैसे किया जाय, इसका मानकीय सिद्धान्त भी।
