यदि अ जानता है कि ब की तिल्ली बढ़ी हुई और इस तथ्य की जानकारी के साथ अ उसकी तिल्ली के क्षेत्र में शक्तिपूर्वक घूँसा मारता है और ब मर जाता है तो यह अपराध हत्या है, अभियोज्य नरहत्या नहीं, क्योंकि अ को विशेष जानकारी थी।

एक समय था जब यह समझा जाता था कि अभियोज्य नरहत्या (धारा २९९) और हत्या (धारा ३००) के बीच का अंतर केवल धारा ३०० के पाँच अपवाद ही हैं।

अभियोज्य नरहत्या हत्या समझी जाती है यदि वह कार्य, जिससे मृत्यु होती है-।

मनुष्य के जीवन के प्रति किए जानेवाले अपराध चार प्रकार के होते हैं - (१) नरहत्या, (२) आत्महत्या, (३) भ्रूणहत्या और (४) शिशुहत्या।

यदि कोई व्यक्ति (१) जान से मार डालने के इरादे से अथवा (२) ऐसी शारीरिक चोट पहुँचाने के इरादे से जिससे मृत्यु संभव हो अथवा (३) यह जानते हुए कि उसके ऐसे कार्य से मृत्यु की संभावना हो सकती है, मृत्यु का कारण बनता है तो ऐसा व्यक्ति अभियोज्य नरहत्या का अपराध करता है (धारा २९९)।

अभियोज्य नरहत्या (अर्थात्‌ अवैध नरहत्या) या तो हत्या की श्रेणी में आती है या हत्या की श्रेणी में नहीं आती।

आधुनिक धारणाओं के अनुसार नरहत्या या तो वैध होती है या अवैध (अथवा अभियोज्य)।

अभियोज्य नरहत्या का अस्तित्व किसी विशेष अपराध के रूप में नहीं है।
