सन्दर्भ हिन्दू अप्राप्तवयता और संरक्षकता अधिनियम, 1956।

(क) किसी लड़के या अविवाहिता लड़की की दशा में-पिता और उसके पश्चात् माता : परन्तु जिस अप्राप्तवय ने पांच वर्ष की आयु पूरी न कर ली हो उसकी अभिरक्षा मामूली तौर पर माता के हाथ में होगी ;।

(क) न तो अप्राप्तवय की स्थावर सम्पत्ति के किसी भी भाग को बन्धक या भारित अथवा विक्रय, दान या विनिमय द्वारा या अन्यथा अन्तरित करेगा ; और।

7. दत्तक पुत्र की नैसर्गिक संरक्षकता-ऐसे दत्तक पुत्र की, जो अप्राप्तवय हो, नैसर्गिक संरक्षकता दत्तक ग्रहण पर दत्तक पिता को और उसके पश्चात् दत्तक माता को संक्रान्त हो जाती है ।

(3) नैसर्गिक संरक्षक द्वारा उपधारा (1) या उपधारा (2) के उल्लंघन में किया गया स्थावर सम्पत्ति का कोई भी व्ययन, अप्राप्तवय की या उससे व्युत्पन्न अधिकार के अधीन दावा करने वाले किसी भी व्यक्ति की प्रेरणा पर शून्यकरणीय होगा ।

हिन्दुओं में अप्राप्तवयता और संरक्षकता से सम्बन्धित विधि के कतिपय भागों।

(ख) न ऐसी सम्पत्ति के किसी भी भाग को पांच वर्ष से अधिक की अवधि के लिए या जिस तारीख को अप्राप्तवय प्राप्तवयता में प्रवेश करेगा उस तारीख से एक वर्ष से अधिक की अवधि के लिए पट्टे पर देगा ।

(क) “अप्राप्तवय' से वह व्यक्ति अभिप्रेत है जिसने अठारह वर्ष की आयु पूरी न की हो ;।

(ii) अप्राप्तवय के पिता या माता की विल द्वारा नियुक्त संरक्षक ;।

11. वस्तुतः संरक्षक अप्राप्तवय की सम्पत्ति के बारे में संव्यवहार नहीं करेगा-इस अधिनियम के प्रारम्भ होने के पश्चात् कोई भी व्यक्ति केवल इस आधार पर कि वह अप्राप्तवय का वस्तुतः संरक्षक है, उस हिन्दू अप्राप्तवय की सम्पत्ति का व्ययन या संव्यहार करने का हकदार न होगा ।

6. हिन्दू अप्राप्तवय के नैसर्गिक संरक्षक-हिन्दू अप्राप्तवय के नैसर्गिक संरक्षक अप्राप्तवय के शरीर के बारे में और (अविभक्त कुटुम्ब की सम्पत्ति में उसके अविभक्त हित को छोड़कर) उसकी सम्पत्ति के बारे में भी, निम्नलिखित हैं :-।

9. वसीयती संरक्षक और उनकी शक्तियां-(1) ऐसा हिन्दू पिता जो अपने अप्राप्तवय धर्मज अपत्यों के नैसर्गिक संरक्षक के तौर पर कार्य करने का हकदार हो, उनमें से किसी के लिए भी उस अप्राप्तवय के शरीर के या उस अप्राप्तवय की (धारा 12 में निर्दिष्ट अविभक्त हित से भिन्न) सम्पत्ति के या दोनों के बारे में विल द्वारा संरक्षक नियुक्त कर सकेगा ।
